Terms and Conditions Policy

1. Introduction These Terms and Conditions govern your use of theeternitymedia.com and the services provided by Eternity Media, a digital marketing agency based in India. By using our website or engaging our services, you agree to these Terms.
2. Services Provided Eternity Media offers a range of digital solutions including:
- Graphic design and brand identity
- Website design and custom development
- Social media management and content strategy
- SEO optimisation
- Digital advertising (Google Ads, Meta Ads, and more)
- AI automation, workflows, AI agents, and chatbots
- Digital marketing strategy and performance tracking
The specific scope, deliverables, timelines, and fees for each project will be outlined in a separate Service Agreement or Proposal agreed upon by both parties.
3. Client Obligations Clients agree to:
- Provide accurate, complete, and timely information, assets, and approvals
- Designate a point of contact responsible for feedback and decisions
- Ensure all materials provided do not infringe any third-party intellectual property rights
- Not use our services for any unlawful or harmful purpose
Eternity Media shall not be held liable for project delays caused by late client feedback, missing assets, or lack of communication.
4. Payment Terms
- All fees are quoted in Indian Rupees (INR) unless otherwise stated
- A deposit of 50% is required before work begins, with the balance due upon completion or per agreed milestones
- For retainer services, payment is due in advance at the start of each billing period
- Invoices unpaid within 14 days of the due date may incur a late fee of 2% per month on the outstanding amount
- All fees are exclusive of applicable taxes including GST
- Final deliverables and files will only be released upon receipt of full payment
5. Cancellation & Refunds
- Either party may cancel an ongoing engagement with 30 days’ written notice
- The client is liable for all fees for work completed up to the cancellation date
- Deposits are non-refundable once work has commenced
- Eternity Media reserves the right to terminate an engagement immediately without refund if a client breaches these Terms or engages in abusive conduct toward our team
6. Intellectual Property
- You retain full ownership of all content, logos, and materials you provide to us
- Upon receipt of full payment, ownership of agreed deliverables (final designs, website files, ad creatives, etc.) transfers to the client
- Until full payment is received, all deliverables remain the property of Eternity Media
- All proprietary tools, frameworks, templates, and methodologies developed by Eternity Media remain our exclusive property
- We reserve the right to display completed work in our portfolio and promotional materials unless a written NDA is in place
7. Digital Advertising Disclaimer Eternity Media manages paid ad campaigns across Google, Meta, and other platforms on behalf of clients. We optimise campaigns to the best of our ability, however:
- We cannot guarantee specific results including leads, conversions, or revenue
- Ad performance is subject to platform algorithms, market conditions, and budget
- We are not responsible for account suspensions, policy changes, or algorithm updates by third-party platforms such as Google or Meta
8. Limitation of Liability
- Our services are provided on a best-efforts basis without warranties of any kind
- Eternity Media shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services
- Our total liability in any circumstance shall not exceed the total fees paid by the client in the 3 months preceding the claim
9. Confidentiality Both parties agree to keep confidential any sensitive or proprietary information shared during the engagement. This obligation survives the completion or termination of any project. Clients may request a formal NDA where required.
10. Governing Law These Terms are governed by the laws of India, including the Information Technology Act, 2000. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. Both parties agree to attempt resolution through good-faith negotiation before pursuing legal action.
11. Changes to These Terms We may update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of the revised Terms.
